Power of Attorney for a Person in Custody in the UAE

If a family member, business partner or client is detained at a police station or detention centre, Wathaq helps prepare a suitable power of attorney and coordinate the signing requirements with the competent authority. We assist families and lawyers in the UAE and overseas. Access, identity verification and voluntary signing must be approved for the individual case.

Start with the location and purpose of the POA

Tell us the emirate, the station or facility, your relationship to the proposed principal, and what the lawyer or agent needs to do. You can start from outside the UAE. Please do not send case files, passport images or confidential allegations in your initial enquiry.

The person in custody is the principal. A relative cannot sign for them simply because they are unavailable; valid authority, identity checks, capacity and freely given consent remain essential.

What we can help prepare

We tailor the wording to the intended task and receiving authority rather than promising unrestricted powers.

  • Appointment of a lawyer for specified proceedings
  • Representation before competent authorities where permitted
  • Company or property administration by an authorised agent
  • Banking or debt-related powers, subject to the relevant institution’s requirements
  • Bilingual drafting, legal review and coordination of eligible notarization

Permission and signing arrangements

The police station or detention facility and the competent notarial authority determine whether and how signing can take place. An ordinary mobile-notary booking or video call does not by itself authorise access to a detainee.

The route may require an approved visit, an authorised remote arrangement or other procedures instructed by the authority. Requirements vary by emirate, facility, the principal’s circumstances and the powers requested. We confirm the feasible route before scheduling.

Passport, Emirates ID and identity verification

A valid passport may support identity verification for eligible transactions when the principal has no Emirates ID. The competent authority may request additional documents, an interpreter or other verification. A passport alone does not guarantee approval for a custody POA.

Urgency, timing and fees

We prioritise urgent enquiries and explain the expected drafting and coordination time after review. Official permission and access control the signing schedule; same-day completion cannot be guaranteed.

You receive a written fee breakdown covering drafting, official charges, translation and any approved attendance or coordination costs. A POA is not a guarantee of release, bail or any outcome in the underlying case.
